2. The petitioner seeks bail in connection with Imamganj P.S. Case No. 100 of 2022 registered for the offence under Sections 370, 371, 363, 374 of the Indian Penal Code.

3. As per the prosecution case, Monu Kumar disappeared on 10.05.2022. Monu Kumar returned from Hyderabad and gave statement under Section 161 of the Cr.P.C. that petitioner's son had taken him to Hyderabad to work in a company.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 27.08.2022 and he has falsely been implicated in this case.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.13996 of 2023(3) dt.28-07-2023 2/2 prayer for bail.

6. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after arrest/surrender of his son namely Sahil Paswan and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- 1st Gaya/concerned Court below in connection with Imamganj P.S.
