Petitioner seeks bail in connection with Ayer P.S. Case No. 26 of 2016 registered under Sections- 304B/34 of the Indian Penal Code.

It is submitted that petitioner is the mother-in-law of the deceased. She is in custody since 09.09.2016. The husband of the deceased is in custody.

Learned counsel appearing for the informant submits that trial of the case has begun and five witnesses have been examined. Status report was called from the Court below wherein it has been stated that four witnesses have been examined. Court below has stated that total 17 witnesses are there and trial is likely to be concluded within six months.

No.8808 of 2017 (5) dt.12-04-2017 2/2 Keeping in view that petitioner is mother-in-law and being a lady and also that there is general and omnibus allegations against her and she is in custody since 09.09.2016, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara in connection with Ayer P.S. Case No. 26 of 2016 with condition that both the bailors must be close relative of the petitioner and petitioner will appear in the Court below on each and every date. Any single default without reasonable cause will amount to cancellation of her bail bonds. Petitioner will also cooperate in the trial and will not tamper with the evidence or harass the witnesses.
