2. The petitioner is seeking regular bail in connection with Hisua P.S. Case No. 113 of 2024, registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.
3. As per allegation, the accused persons including the petitioner enticed away minor daughter of the informant.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the victim has filed an application before the ACJM-IV, Nawada stating therein that she has solemnized love marriage with the petitioner. She has stated her age as 18 years in her application and the learned Magistrate has assessed her age as 17 years, which shows that she is on the
Patna High Court CR. MISC. No.13094 of 2025(3) dt.15-05-2025 2/2 verge of majority.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Nawada in connection with Hisua P.S. Case No. 113 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
