This application is for grant of regular bail in connection with Nawada Mahila P.S.Case No.41 of 2016, for the offences under Sections 366, 368, 376, 323, 120(B) & 379 of the Indian Penal Code.

Allegation against the petitioner is of commission of rape on the prosecutrix.

It is submitted on behalf of the petitioner that the prosecutrix has failed to establish second place of occurrence, which will appear from Para 52 of the case diary and the petitioner is in custody since 02.01.2017.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.10669 of 2017 (3) dt.27-04-2017 2/2 Having heard both sides and in view of the fact that there is direct allegation against this petitioner of commission of rape, which has been supported by the statement of the prosecutrix under Sections 164 Cr.P.C., as such, I am not inclined to grant bail to the petitioner.

With the aforesaid observation, this application is dismissed.
