The petitioner seeks bail in connection with Naya Ram Nagar (Safiyasarai) P.S. Case No.151 of 2016 registered under Sections 147, 148, 149, 384, 386, 307 and 504 of the Indian Penal Code besides Section 27 of the Arms Act.
The accusation is that four persons, named in the F.I.R., including the petitioner and 4-5 unknown armed with pistol came near Dakra Nala pond, where the informant after collecting the fish, was selling the fish and started to abuse the informant and Natho Yadav asked the informant as to why he has not paid Rs.5,00,000/- as demanded by him as ransom and in that course, Natho Yadav, on the point of pistol, snatched Rs.40,000/- from the
Patna High Court Cr.Misc. No.3397 of 2017 (2) dt.10-02-2017 2/3 pocket of the shirt of the informant and asked that this amount is as of ransom and further asked the informant that if the remaining amount of ransom has not been paid by him, he would be shot fire. At that time, Manoj Yadav asked to carry the informant so that the ransom amount could be realized and, thereafter, they informant was taken by all the accused including the petitioner to Bahiyar but, anyhow, he succeeded to flee away. At the time of firing, no one sustained injury.
Learned counsel appearing on behalf of the petitioner submits that the petitioner and other accused are of same family. There was dispute with regard to take the auction of the Dakra Nala pond in between the family of the petitioner and the informant and several complaint petitions were also filed by Natho Yadav, the grand father of the petitioner against the informant of the present case before the Reveune officials and police officials. Due to that reason, the present case has been lodged with false allegation by the informant. The petitioner is in custody since 21.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
