JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-08-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Damodar Prasad Tiwary, learned APP for the State.
The petitioner in the present case is seeking regular bail in connection with Daudnagar P.S. Case No. 133 of 2020 for the offences registered under Section 216(A) of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act. He is in custody in connection with this case since 17.5.2020.
Learned counsel for the petitioner submits that as per the prosecution story when the police party raided the house of Ramnath Singh who is brother-in-law of this petitioner, the petitioner was also found present there and from his possession one pistol and three live cartridges were recovered. From the house of Ramnath Singh one rifle and one pistol along with 39 cartridges and four empty
Patna High Court CR. MISC. No.21006 of 2021(2) dt.04-08-2021 2/2 cartridges were recovered.
Learned counsel submits that this petitioner has got criminal antecedent of twenty cases, however, he is on bail in eighteen cases.
Learned APP for the State has opposed the prayer for bail of the petitioner. It is submitted that presence of the petitioner in the house of Ramnath Singh who is his brother-in-law and recovery of several arms and huge quantity of ammunitions together with the criminal antecedent of twenty cases against the petitioner and further recovery of one pistol and three live cartridges from his possession are some of the factors which should be taken into consideration and the prayer for bail of the petitioner be rejected. Considering the facts and circumstances of the case, the recovery of arm and ammunitions from the possession of the petitioner and from the house where he was also present and further twenty huge criminal antecedents against the petitioner are the reasons which do not permit this Court to grant privilege of bail to this petitioner.
Prayer for bail is thus refused.
Let the trial be expedited.
