A counter affidavit has been filed which is taken on record.

The petitioner is aggrieved by transfer of Case No. 735 of 2002 by the Collector to the Court of Additional Collector for disposal.

Learned counsel for the State with reference to the statement made in the counter affidavit has submitted that under the relevant Act the Collector as well as the Additional Collector can exercise the jurisdiction and as such there is no legal infirmity. He points out that the said proceeding is still pending
