JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-b), 26/35 of the Arms Act.

The first information report itself, reflects that neither any firearm nor any stolen property was recovered from conscious possession of the petitioner. The informant claims in his self statement that on the basis of disclosure, made by the petitioner, other co-accused were arrested and firearms as well as looted property was recovered.

Learned counsel appearing for the petitioner submits that petitioner was made accused in five cases but, as a matter of

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P. S. Case No. 590 of 2018.
