This application is for grant of bail in connection with Laheri P.S.Case No.232 of 2016 for the offence under Sections 363, 366(A), 34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that his name transpired later on, on the basis of suspicion during the course of investigation but the other accused persons, having similar circumstances and their name also transpired during the course of investigation, have been granted bail and the main allegation is against two other accused persons, who are named in the F.I.R. itself and they have also been granted anticipatory bail. The case of the petitioner is on better footing than that of those accused persons.
Patna High Court Cr.Misc. No.6754 of 2017 (4) dt.03-03-2017 2/2 Heard learned A.P.P., who has opposed the prayer for bail. Having heard both sides. In view of the fact that there are some materials against the petitioner and he has been made accused on the basis of suspicion during the course of investigation of the case. As such, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail in the learned court below itself, after framing of charge and the learned court below will consider all aspects of the matter and will pass appropriate order considering the fact that other accused persons, having similar allegation, have been granted bail. With the aforesaid observation, this application is dismissed.
