SINHA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 302 of the Penal Code It is submitted on behalf of the petitioner that for the incident in question two First Information Report were registered. One by the wife of the deceased Raj Kumari Devi on 27.07.2012 in which one Satyendra Bhagat is named as accused. The other First Information Report has been registered on 01.08.2012, Annexure-2 in which petitioner is named as one of the accomplice of the assailant. It is submitted that the subsequent First Information Report was registered by the father after learning about the occurrence from the wife of the deceased, who

No.11435 of 2015 (3) dt.22-05-2015 2/2 registered the present First Information Report in which petitioner has not been named as accomplice, as such, the subsequent statement may be recorded by the father but on instruction from the wife the first informant, may be doubted even at this stage. Without expressing any opinion about the submission made by the learned counsel for the petitioner, I direct the petitioner, named above, to surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and thereafter be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 91/2012, subject to the conditions laid down under Section 438(2) Cr.P.C.
