JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Khagaria P.S. Case No.698 of 2916 registered for the offence under Section 8/20(b)(II)(A) of N.D.P.S. Act.

The accusation against the petitioner is of recovery of 175 gram ganja from the pocket of the jacket of the petitioner. It is submitted that the recovered ganja is of small quantity. The petitioner is in custody since 14.12.2016. In paragraph 3 of the petition it is mentioned that the petitioner has got clean antecedent.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, above named,

No.8716 of 2017 (2) dt.10-03-2017 2/2 be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge- cum- Special Judge, Khagaria,, in Special Case No.18/16 arising out of Khagaria P.S.Case No.698 of 2016, subject to the condition that both the bailers shall be the close relative of the petitioner.
