JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners are accused in connection with Triveniganj P.S. Case No. 89 of 2016 registered under Section 392 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. rather in course of investigation their names have been surfaced on the basis of confessional statement of one Sarfaraj Aktar @ Guddu, who was apprehended by the police in connection with Madhepura P.S. Case No. 430 of 2016, saying that petitioners were involved in Madhepura P.S. Case No. 430 of 2016. Thereafter, petitioners were apprehended by the police in the present case and also
Patna High Court Cr.Misc. No.3412 of 2017 (2) dt.10-02-2017 remanded in three other cases as detailed in paragraph 3 of the bail petition. Further submission is that petitioners are in custody since 24.10.2016 but they have not put on T.I. Parade while the informant has detailed the physic of the culprits. Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Supaul, in connection with Triveniganj P.S. Case No. 89 of 2016. Out of two sureties, one surety must be the close relative of the petitioners.
