The petitioners apprehend their arrest in Belaganj P.S. Case No.22 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioners submits that the police arrested two persons, namely, Jitan Choudhary and Lekhraj Choudhary and from their possession, country made liquor was recovered. They disclosed the name of petitioners Karu Singh and Binod Kumar Yadav but nothing has been recovered from conscious possession of the petitioners. The apprehended accused on account of village politics implicated the petitioners.
Having considered the fact that the petitioners were
Patna High Court Cr.Misc. No.10773 of 2019(2) dt.22-02-2019 2/2 not apprehended nor anything was recovered from conscious possession of the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Belaganj P.S. Case No.22 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
