JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

The prosecution case is that the petitioner applied for being appointed on the post of A.N.M but at the time of counseling her nursing certificate was found forged. It is submitted by learned counsel for the petitioner that in fact the petitioner was never been appointed on the basis of the said document nor any loss was caused to the State exchequer, hence, the offences alleged are not made out. It is further submitted that similarly situated co-accused Kumari Sima and Beauty Kumari have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 25761 of 2015 and Cr. Misc. No. 40275 of 2015.

Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 253 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
