Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Hulasganj P.S. Case No. 155 of 2019, registered for the offences punishable under Sections 341, 323, 504, 506, 509, 307, 379 and 34 of the Indian Penal Code.

Prosecution case in brief is that on 27.10.2019 while the informant was going to see the idol at village Kedarpur, in

No.11039 of 2020(2) dt.16-06-2020 2/2 the way, co-accused Birendra Bind assaulted the informant with lathi on his head, as a result of which the informant sustained head injury. On hulla, when the informant's Bhabhi came there to save him, the accused persons also assaulted her, as a result of which she sustained injury on her right hand. They also snatched away cash of Rs. 50,000/- from possession of the informant. It is submitted that petitioners have falsely been implicated in this case. There is general and omnibus allegation against these petitioners. There is case and counter case. Moreover, specific allegation of assault is against co-accused Birendra Bind. The petitioners have got clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 155 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
