The petitioner seeks regular bail in connection with Khajauli PS case no. 198 of 2018 registered for the offence punishable under Sections 272, 273, 290/34 of Indian Penal Code, 30(a), 37(b)(c) of Bihar Prohibition and Excise Act and 25(1-b)A, 26, 35 of Arms Act.

The allegation is regarding the police having raided the place in question where the accused persons were drinking illicit liquor and upon search, one countrymade pistol along with live cartridges was recovered from the possession of co-accused Satya Narayan Das.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present

It is further submitted that the arms and illicit liquor have not been recovered from the conscious possession of the petitioner. The petitioner is said to have languishing in custody since 08.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge II-cum-Special Judge Excise Act, Madhubani in connection with Khajauli PS case no. 198 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
