====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-03-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 127(1), 115(2), 117(2), 303(2), 109, 352, 351(2), 191(2), 190 of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 27.10.24 at about 6 AM, while informant and her husband went for morning walk, in the meantime, these petitioner along with other F.I.R. named

Patna High Court CR. MISC. No.11076 of 2025(2) dt.18-03-2025 2/3 accused persons attacked them. It is alleged that all the accused assaulted husband of the informant by means of various weapons as a result of which he sustained injury on hand and neck.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Allegation of assault and theft is general and omnibus and there is no specific allegation of overt act against these petitioners. Case and counter case. Doctor has found the injury to be simple in nature.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, case and counter case and simple injury, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Aurangabad (Bihar) in connection with Rafiganj P. S. Case No. 622 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha
