The petitioner is accused in connection with Delha P.S. Case No. 172 of 2016, registered under Section 399, 402 of the Indian Penal Code and Section 25(1-B)(a) 26 and 35 of the Arms Act.
The accusation is that seven persons named in the F.I.R. including the petitioner, were apprehended by the Police. On search, two live cartridges were found in possession of the petitioner.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Further submission is that petitioner is accused in three other cases, but he is on bail in that case. Further submission is that petitioner is
Patna High Court Cr.Misc. No.3436 of 2017 (2) dt.13-02-2017 2/2 in custody since 02.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Delha P.S. Case No. 172 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
