The petitioner is languishing in custody since 09.05.2018 in a case for the offence registered under Sections 364(A) and 120(B)/34 of the IPC.
The prosecution story, in brief, is that on 07.05.2018, unknown criminals kidnapped the minor daughter of the informant, namely, Navya, aged about 8 years, when she was coming from the School. Informant reached at the place of occurrence but at that time, he did not find his daughter. Nearby shopkeepers informed that they have seen a white colour car, which was running rashly.
It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.10472 of 2019(3) dt.02-05-2019 2/2 petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The victim has been recovered. Her statement has been recorded under Section 161 Cr. P.C. The victim has not named this petitioner.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Purnea, in connection with Sessions Trial No. 447 of 2018, arising out of Sadar P.S.
