JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 364/302/201/120B/34 of the Indian Penal Code.

The petitioner and others are suspected to have committed murder of the father of the informant. Co-accused Ehshan Ansari has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.8964 of 2016.

Learned counsel for the State does not dispute that allegation against the petitioner is similar to Ehshan Ansari and the only material against the petitioner is last seen with the

Patna High Court Cr.Misc. No.17292 of 2017 (2) dt.11-04-2017 2/2 deceased.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/Successor Court, in connection with Katoriya (Suiya) P.S. Case No.20 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
