The Petitioner seeks bail in Khodawandpur P.S. Case No.155 of 2016 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.
As per allegation, altercation took place between the petitioner and the deceased son of the informant on account of mobile. It is alleged that petitioner and co-accused, Rakesh Kumar, had taken the son of the informant on a motorcycle and on the next day the informant got information that dead body of his son is lying by the side of the road. The informant has raised suspicion against the petitioner.
Case diary has been received.
Counsel for the State has submitted that besides the
Patna High Court Cr.Misc. No.19560 of 2017 (3) dt.25-05-2017 2/2 allegation that the petitioner had taken the deceased with him, there is no other allegation of any specific overt act against the petitioner.
Petitioner is said to be in custody since 09.01.2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Manjhaul, Begusarai, in connection with Khodawandpur P.S. Case No.155 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
