This application has been filed for cancellation of bail granted to the petitioner by order dated 04.12.2018 passed in Sahiyara P.S.Case No.183 of 2018 registered for the offences under Sections 323, 379, 504 and 354 of the Indian Penal Code as well as Sections 3(i)(r)(s) SC/ST Act.

The grounds for cancellation of bail is that the petitioner has got criminal antecedent and also suppressed his criminal status which appears from Annexure-2 of this application and he obtained the bail by the learned Additional Sessions Judge, Sitamarhi.

No.14538 of 2019(2) dt.17-02-2020 2/2 Considering the period of incarceration and the other materials, the Opposite Party No.2 was granted bail by the learned Additional Sessions Judge and no doubt it appears that he is an accused in three other cases which appears from Annexure-2, i.e., the forwarding report but those cases under Sections 147, 149, 341, 323, 504, 379 and 354 of the Indian Penal Code. There is no allegation of misuse of privilege of bail or tampering with the evidence by the petitioner. Heard learned APP.

Considering the aforesaid facts, I am not inclined to interfere with the earlier order passed by the learned Additional Sessions Judge, Sitamarhi by order dated 04.12.2018. Accordingly, this application is dismissed.
