JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-05-2015 Since both the cases have arisen out of one occurrence, they are being disposed of by this common order. Heard both sides.

Patna High Court Cr.Misc. No.13660 of 2015 (2) dt.07-05-2015 2/3 The petitioners apprehend their arrest in Barh P.S. Case No. 42 of 2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.

Chandrakant Singh the informant named these petitioners along with other accused persons and alleged that while his nephew Santosh Singh was returning after irrigating his field all the accused persons surrounded him and began to assault. It is further alleged that on the order of Anuj Singh, Rinku Singh opened firing which hit Santosh Singh in his abdomen. Thereafter, the accused persons made indiscriminate firing. Learned counsel for the petitioners submits that Santosh Singh got one firearm injury in his abdomen. Later on the informant himself developed a case and disclosed that the petitioners also assaulted him, but the firing made by the petitioners did not hit Santosh Singh. The case of Sonu Singh is similar to that of the petitioners. Sonu Singh has already been enlarged on bail by the learned Sessions Judge vide order passed in A.B.P. No. 1166 of 2015.

Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of

No.13660 of 2015 (2) dt.07-05-2015 3/3 receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 42 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
