This is an application for bail in connection with Gopalpur P.S.Case No. 134 of 2016 registered for the offences punishable under Sections 272, 273, 414/34 of the Indian Penal Code and Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.
It has been submitted on behalf of the petitioner that charge-sheet has been submitted in this case and petitioner has clean antecedent and has remained in custody for more than two months and has falsely been implicated.
Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the fact that
Patna High Court Cr.Misc. No.9205 of 2017 (2) dt.28-02-2017 2/2 there is recovery of 80 litres of liquor from the petitioner, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail before the court below after completion of six months in custody. With the above observation, this application is dismissed.
