The petitioner no.1 being the PACS Godown Manager and petitioner no. 2 being the wife of petitioner no. 1 are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 384, 504/34 of the Indian Penal Code.
It is alleged that the informant being Chairman of the PACS found the lock of the PACS godown being changed and on query petitioner no. 1 admitted that he has locked the godown and demanded extortion.
Subsequently petitioner abused and assaulted with fists and slaps to the informant.
Patna High Court Cr.Misc. No.13958 of 2015 (2) dt.03-04-2015 It is submitted by the learned counsel for the petitioners that the petitioner no. 1, being Manager of the PACS godown restrained the informant to interfere with the work of the petitioner no. 1 hence the present case has been lodged with false accusation.
Considering the nature of accusation, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gopalganj in connection with Kateya P.S. Case No. 13 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
