JUSTICE SANJAY PRIYA ORAL ORDER 3/ 03-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Dhoraiya (Dhankund) P.S. Case No.68 of 2016 giving rise to Sessions Trial No.226 of 2016 instituted for the offence under Section(s) 25(1-b) a, 26, 29 of the Arms Act.

It has been submitted that the petitioner is in custody since 01.04.2016. It is alleged that one loaded country made pistol, four live cartridges and three used cartridges along with one knife were recovered from the possession of this petitioner. The police after investigation has submitted charge-sheet against the petitioner under Section 25(1-b)a, 26, 29 of the Arms Act. A report was called for from the Court below, which has been received and kept at flag-'A', wherein, it has been stated

Patna High Court Cr.Misc. No.7288 of 2017 (3) dt.03-04-2017 2/2 that charge has been framed and the case is fixed for evidence. Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, IV, Banka, in connection with the Sessions Trial No.226 of 2016 arising out of Dhoraiya (Dhankund) P.S. Case No.68 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.

The petitioner will remain present during trial and will not tamper with the evidence and hamper the trial. Absence of the petitioner on two consecutive dates will amount to cancellation of bail bond of the petitioner.
