This application is for grant of bail in connection with Laxamipur (Gidhaur) P.S.Case No.70 of 2015 for the offence under Section 392 of the Indian Penal Code.
It is submitted on behalf of the petitioner that except the confessional statement, there is nothing against the petitioner and he is in custody for more than one year.
Heard learned A.P.P. also.
Having heard both sides and from perusal of the impugned order itself, it appears that the looted Motorcycle as well as 'Katta' and cartridges were recovered from the possession of the petitioner, that appears from para 63 of the case diary. Apart from that the petitioner is accused in 10 other cases.
Patna High Court Cr.Misc. No.16061 of 2017 (2) dt.07-04-2017 2/2 Considering the aforesaid facts, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months.
Further, the S.P., Jamui is directed to ensure production of witnesses in the court concerned on day-to-day basis so that the trial may be concluded within the period as specified. It is also directed that this Court will take serious view of the matter, if the direction is not complied or there is any laxity in producing the witnesses or not conducting the case on day-to-day basis.
With the aforesaid observation, this application is dismissed.
