The sole petitioner, apprehending his arrest in connection with Complaint Case no.1234 / 2014 registered for the offence under Sections 406, 420 of the Indian Penal Code, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that in a case of civil nature, the complainant has given a colour of criminal offence.

Besides hearing learned counsel for the parties, I have also perused the materials available on record. In view of nature of

No.5733 of 2016 (2) dt.19-02-2016 2/2 accusation, let the petitioner, namely, Vijay Sharma ,in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sasaram, Rohtas in connection with Complaint Case no.1234/2014 , subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
