This is an application for bail in connection with Paroo P.S.Case No. 125 of 2015 for the offences punishable under Sections 270, 272, 273, 420, 471/34 of the Indian Penal Code and 47A of Excise Act.

It has been submitted on behalf of the petitioner that there is alleged recovery of 83 litres of country made wine but petitioner has clean antecedent and remained in custody for about three months.

Heard learned APP also.

Having heard both sides and from perusal of the record it appears that this case is of the year 2015 and the case other co-accused persons was separated from the petitioner and by

Patna High Court Cr.Misc. No.13625 of 2017 (2) dt.22-03-2017 2/2 now the case has been committed to the court of sessions, as such, I am not inclined to grant bail to the petitioner. However, trial court is directed to expedite the committal proceeding of the petitioner so that all the accused persons may be tried together.

The petitioner may renew his prayer for bail before the court below itself, who will consider criminal antecedent of the petitioner as well as materials available on the record and pass appropriate order.

Accordingly, this application is dismissed.
