The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,354,379 and 436/34 of the Indian Penal Code. It is alleged that the informant complained about the misbehaviour of co accused Md. Raza then these petitioners along with others made assault when the specific accusation of litting fire to the house of informant is against petitioner nos. 2 and 3 above named. Patna High Court Cr.Misc. No.10883 of 2015 (2) dt.28-04-2015 2/3 petitioners that there is counter version of the occurrence also and the informant has retracted from the initial version.

Considering the fact that specific accusation of litting fire is against petitioner nos. 2 and 3, let the learned court below consider the prayer for regular bail of the petitioner nos. 2 and 3 above named in case the petitioner nos. 2 and 3 surrender within six weeks from today in connection with Sakara P.S. Case No. 583 of 2014 pending in the court of learned C.J.M., Muzaffarpur.

So far as petitioner nos. 1,4 and 5 above named are concerned, it is submitted by learned counsel for the petitioners that no injury has been caused to the informant, there is counter version of the occurrence and the informant has retracted from the initial version. Considering the aforesaid facts, let the above named petitioner nos. 1,4 and 5 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection

Patna High Court Cr.Misc. No.10883 of 2015 (2) dt.28-04-2015 3/3 with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
