2. The present writ petition has been filed for quashing the order dated 13.12.2021 passed in Mutation Case No. 27661R27/2021-22 as well as Mutation Appeal Case No. 52/2022-23 under the Bihar Land Mutation Act, 2011 [Bihar Act 23 of 2011].
3. Learned counsel for the petitioner submits that for the said land, he has title in his favour from the court of competent civil court. In the said title suit the State was party.
4. Learned counsel for the State submits that the
Patna High Court CWJC No.3264 of 2023(2) dt.20-07-2023 2/2 statutory remedy under the aforesaid Act is available to the petitioner by way of filing mutation revision and it is not exceptional circumstances to entertain the writ under Article 226 of the Constitution of India.
5. In this view of the matter, this writ petition is disposed off, granting liberty to the petitioner to avail his remedy under Statute by way of filing revision.
6. Delay, if any, in filing the revision is hereby condoned.
