The claim for grant of B.A. trained to the petitioner is rejected by the Court itself, because the petitioner is holder of Sahitya Alankar Degree from Hindi Vidyapeeth, Deoghar, which is no degree in the eye of law, much less equivalent to a B.A. degree, as has already held not only by this Court, but upheld even by the Hon'ble Supreme Court.

Petitioner is a retiree of 31st of January, 2008. His claim of grant of benefit of A.C.P. would surely require to be considered. The District Programme Officer (Establishment), Madhubani must take cognizance of Annexure-2 and communicate his decision for such a claim of grant of benefit of A.C.P. in accordance with

Patna High Court CWJC No.5644 of 2015 dt.05-05-2015 2/2 prevalent rules within a reasonable time-frame of four months.

Writ application stands disposed off with observation / direction as above.
