Petitioner seeks bail in connection with Chandramandih P.S. Case No. 76 of 2016 registered for the offences under Sections- 302/34, 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the first information report. Petitioner has been implicated in this case on confessional statement of co-accused. Petitioner has not been put on Test Identification Parade till date.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation
Patna High Court Cr.Misc. No.16179 of 2017 (3) dt.08-05-2017 2/2 against this petitioner alongwith Ranjit Tanti. Recovery of iron Hasua has been made from the co-accused Ranjit Tanti. Considering the nature of allegations levelled against this petitioner and the submissions made on behalf of the parties, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
