This is the second attempt on behalf of the petitioner for grant of bail in connection with Nautan P.S. Case No.118 of 2024 registered for the offence under sections 365 and 366 of the Indian Penal Code but the charge-sheet has been submitted under sections 302, 201, 120-B/34 of the Indian Penal Code.

Earlier, the prayer of the petitioner for grant of bail has been rejected vide order dated 28.08.2024 passed in Criminal Miscellaneous No.59285 of 2024 on the ground that the petitioner had actively participated in the killing of the deceased.

Pursuant to last order dated 26.09.2025, the trial court has sent the report regarding stage of the trial. From

Patna High Court CR. MISC. No.10942 of 2025(5) dt.07-11-2025 2/2 the report, it appears that the trial has started and out of seven witnesses, three witnesses have already been examined. 5.

Considering the gravity of the offence and also the fact that the trial has proceeded, I am not inclined to grant bail to the petitioner. Accordingly, this bail application is rejected. The trial court is directed to expedite the trial and conclude the same as early as possible.
