====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-03-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 132, 318(4), 329(4), 338, 221, 223 of the Bharatiya Nyaya Sanhita.

3. According to F.I.R., allegation against this petitioner is that he was running a community health center without necessary documents and qualification. It is further alleged that in course of raid, some medical equipment were also found.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner has obtained a certificated in Community Health from National Institute of Open Schooling and pursuant to the same, he was running a

Patna High Court CR. MISC. No.11084 of 2025(2) dt.18-03-2025 2/2 health center and used to provide first-aid services. There is no such allegation that petitioner ever caused any harm to any person of the locality. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Adapur P. S. Case No. 385 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
