This application has been filed for restoration of Cr.W.J.C. No.222 of 2014 which has been dismissed for nonprosecution vide order dated 23.11.2015. It is contended by the learned counsel for the petitioners that due to inadvertence the office clerk failed to mark the cause
Patna High Court MJC No.1634 of 2016 (3) dt.05-10-2016 2/2 list on 23.11.2015 as a result of which he could not appear before the Court and the application was dismissed for non-prosecution. Learned counsel for the State does not oppose the prayer made on behalf of the petitioner for restoration of the application. Having regard to the submissions made at the Bar, the prayer is allowed. Cr.W.J.C. No.222 of 2014 is restored to its original file.
