JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2017 The petitioner is in custody since 20.10.2016 in connection with Sepcial Case No. 80 of 2016, arising out of Salimpur P.S. Case No. 138 of 2016, registered for offences punishable under Sections 20 and 22 of N.D.P.S. Act. It has been submitted on behalf of the petitioner that it has been alleged that in this case, 32 kilogram and 820 gram of ganja has been recovered, however the same has not been recovered from the conscious possession of the petitioner rather the same was recovered from a boat of which the petitioner and other three accused persons were passengers.

Learned counsel for the state opposed the prayer for bail and submitted that in this case altogether 32 kilo and 820 gram of ganja has been recovered, which is a huge quantity.

No.13951 of 2017 (2) dt.27-03-2017 2/2 Having heard both sides, in view of the fact that in this case huge quantity of ganja has been recovered and the petitioner was apprehended on spot, as such, I am not inclined to grant the petitioner, the privilege of regular bail, it is accordingly rejected. However, the trial court is directed to expedite the trial and try to conclude it as soon as possible.

With the above observation, this application is dismissed.
