The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 54 liters of country-made liquor has been recovered from the bank of river and petitioner is alleged to be one of the persons, who brought the aforesaid liquor.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and he has been made accused only on suspicion. Recovery has been made from an open place. Petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, let

No.11365 of 2022(2) dt.08-07-2022 2/2 the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Siwan / Exclusive Special Excise Court No. 1, Siwan in connection with Daraunda P.S. Case No. 329 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
