This application is for grant of regular bail in connection with Sonepur Rail P.S.Case No.84 of 2016, for the offences under Sections 379 and 411 of the Indian Penal Code. Allegation against the petitioner is that the petitioner is not named in the F.I.R. rather his name transpired during the course of investigation.

It is submitted on behalf of the petitioner that except confessional statement of the co-accused, there is nothing against the petitioner and he is in custody for more than four months. So far antecedent of the petitioner is concerned, he is on bail in two cases and in one case, there is a direction for conclusion of the trial.

Patna High Court Cr.Misc. No.18095 of 2017 (2) dt.20-04-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of criminal antecedent of the petitioner as well as allegation against him, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
