JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-07-2020 Heard learned Counsel for the petitioner, learned Counsel for the informant and learned Additional Public Prosecutor representing the State, through Video Conferencing. This application, for grant of anticipatory bail, arises out of Siwan Mufassil Police Station Case No. 166 of 2019, disclosing offences under Sections 341/323/44/307/302/34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner assaulted the daughter of the informant (now deceased) by sharp-cutting weapon and pistol also. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case along with other co-accused persons. He further submits that the allegation
Patna High Court CR. MISC. No.10959 of 2020(2) dt.09-07-2020 2/2 against the petitioner is of firing upon the deceased, but no firearm injury has been found on the person of the deceased. He further submits that the petitioner is the husband of the deceased and there is no motive assigned against him.
Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is named in the First Information Report and there is specific allegation against him of assaulting the deceased by means of sharp-cutting weapon as well as fire arm, I am not inclined to grant the petitioner privilege of anticipatory bail. This application is, accordingly, dismissed.
