2. The present writ petition has been filed for the following reliefs:
"That this writ application is preferred for issuance of an appropriate writ/writs, order/orders, direction/directions nature of Mandamus for Commanding and directing the respondent authorities with respect to an order decide the case of the petitioner, which is pending since 2014 in spite of the several efforts the respondent no.2 did not hold the court and during the pendency of Ceiling Appeal No.11 of 2013-14. The respondent no.3 D.C.L.R. Jagdishpur had executed the sale deed on 30.09.2016 in favour of the Respondent No.5 and on the basis of that private Respondent is bent upon the dispossessed the peaceful possession
Patna High Court CWJC No.20389 of 2016(2) dt.25-08-2025 2/2 of the petitioner after execution of sale deed by Surendra Prasad, Chief Assistant of D.C.L.R. District Bhojpur. The petitioner approached to the Collector, Bhojpur at Arah requesting him to stay the impugned order dated 10.02.2014, but unfortunately the Collector, Bhojpur has refuse to considered the grievances of the petitioner. The petitioner prayed for a direction may be issued to the State Respondents as well as private respondents not to disturb the peaceful possession of the petitioner till the disposal of Ceiling Appeal No.11 of 2013-14 by issuance of appropriate writ and direction, commanding the concerned respondents not to enforce the illegal order."
3. In the present case, it has been informed by the learned State counsel that it is a pre-emption matter and stands abated. Though the writ petition has become infructuous, since there is no appearance on behalf of the petitioner, the same is dismissed for non-prosecution.
