2. The petitioner seeks bail in connection with Kudhani P.S. Case No. 143 of 2025 instituted for the offences under Sections 80 of the Bharatiya Nyaya Sanhita.

3. The informant lodged the F.I.R. with the allegation that his daughter solemnized love marriage with Sonu Kumar and she was living with him. On 09.10.2025 he received information that the girl has died. The post-mortem shows the oblique ligature mark and the conclusion of post-mortem is that death was caused by asphyxia as a result of hanging. The girl apparently committed suicide.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is in custody since 11.10.2025 and

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. The absence of 304B would not give the benefit of presumption of under Section 304B of the IPC to the prosecution and they will have to prove the case on normal evidence. Considering that the girl committed suicide, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Muzaffarpur(West)/concerned Court in connection with Kudhani P.S. Case No. 143 of 2025.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
