The Petitioner seeks bail in Bahadurpur P.S.
Case No. 297 of 2016 instituted for the offence under Section(s) 401, 413, 414, 467, 468, 420 of the Indian Penal Code. As per written report, one motorcycle alleged to be stolen one was recovered from co-accused Md. Nasim. He disclosed about different theft motorcycles and also took the name of this petitioner that he is also keeping the theft motorcycles. The police, thereafter reached to the house of this petitioner and recovered one Yamaha motorcycle as mentioned in the written report.
It has been submitted on behalf of the petitioner
Patna High Court Cr.Misc. No.9666 of 2017 (3) dt.11-04-2017 2/2 in para 8 of the bail petition that recovered Yamaha motorcycle from the house of the petitioner was own motorcycle of the petitioner purchased from one Prandhir Prasad on 20.07.2016. The copy of the sale deed has been annexed as Annexure-2. It has further been submitted that one of the co-accused Dinesh Thakur has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 45057 of 2016.
The petitioner is said to be in custody since 27.07.2016.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 297 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
