JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 323, 307, 411, 413, 414 and 353/34 of the Indian Penal Code and Sections 27 and 35 of the Arms Act. A loaded country made pistol was recovered from the possession of this petitioner. The petitioner is in custody since 24.6.2016. In paragraph 3 of the bail petition, the petitioner has disclosed his criminal antecedents which are cases under Sections 394, 392 as well as under the provisions of the Arms Act. Considering the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the

Patna High Court Cr.Misc. No.14359 of 2017 (2) dt.29-03-2017 like amount each to the satisfaction of learned C.J.M., Gopalganj/Successor Court, in connection with Manjhagarh P.S. Case No.122 of 2016, subject to the condition that one of the bailors shall be a government servant and another bailor shall be family member of the petitioner and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.

The learned trial court is directed to expedite the trial.
