JUSTICE RAJESH KUMAR VERMA ORAL ORDER 10-05-2024 Heard Mr.Narendra Kumar, learned counsel for the petitioner, Mrs. Archana Sinha,learned counsel for the informant and Mr.Shailendra Kumar, learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail, who is in custody since 26.11.2021 in connection with Nawkothi P.S. Case No.71/21, F.I.R. dated 27.05.2021 registered for the offence punishable under Sections 307,326/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. According to prosecution case, this petitioner in conspiracy with other co-accused persons have fired upon the informant. It is further alleged that the petitioner,

4. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

Learned counsel for the informant and learned APP for the State, on the other hand, have vehemently opposed the prayer for bail of the petitioner and submits that from a bare perusal of the FIR it appears that there is direct and specific allegation against the petitioner that he alongwith other co-accused persons fired upon the victim and the informant, who is victim of the case, has categorically stated that the petitioner has fired upon him and apart from that, the petitioner carries seven more cases other than the present one but fairly submits that the petitioner is on bail in all the cases, as mentioned in para-3 of the bail petition.

6. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with

7. Prayer is refused.
