JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 366, 366(A) of the Indian Penal Code. Accusation is of kidnapping the minor daughter (Geeta Kumari) of the informant by Deepak Kumar.

Submission is that the petitioner is not named in the FIR. In course of investigation the names of Baby Devi and her husband Sathu Paswan have come in the confessional statement of co-accused Deepak Kumar having hand in kidnapping of Geeta Kumari. Thereafter Baby Devi and Sathu Paswan disclosed the name of the petitioner. Further submission is that except confessional statement of co-accused Baby Devi and Sathu Paswan, no material has been collected by the investigating officer

Patna High Court Cr.Misc. No.20040 of 2017 (2) dt.10-05-2017 2/2 during the course of investigation. More so, the victim in her statement recorded under Section 164 Cr.P.C. has only disclosed the name of Deepak Kumar.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum- Special Judge POCSO Act, Muzaffarpur, in connection with Paroo P.S.Case No. 337 of 2014.
