JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Complaint Case No. 1567 of 2010, registered under Sections 420 and 506 of the Indian Penal Code and Section 138 of the N.I. Act. The accusation is that petitioner and one Guddu Kumar took cash of Rs.1,00,000/- from the complainant for installation of mobile tower in his land but the mobile tower was not installed. When the complainant asked to return the money then two cheques, of Rs. 20,000/- and Rs. 25,000/- were issued by this petitioner but both cheques were dishonoured. Thereafter,

Patna High Court Cr.Misc. No.3462 of 2017 (2) dt.14-02-2017 complainant made request to return the money, on which, he was threatened of dire consequences by this petitioner and one Guddu Kumar.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 13.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Bhabua, Kaimur, in connection with Complaint Case No. 1567 of 2010.
