Mr.Binod Kumar ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 04-12-2019 Instant petition under Sections 439 and 440 of Criminal Procedure Code has been moved for grant of bail in F.I.R. No. 45 of 2014 dated 20.05.2014 registered at Police Station Rani Talab, District-Patna under Sections 302 of the Indian Penal Code.
Petitioner is in custody since 25.08.2015 in relation to an offence allegedly committed in the year 2014. Having heard learned counsel for the petitioner, this Court is not inclined to grant bail for there is direct evidence with regard to complicity of the accused in the alleged murder of his wife, which took place on 20.05.2014 and this Court has already directed the trial court to expedite the trial. Whether it ought or could have so directed is a different matter but since the
Patna High Court CR. MISC. No.25826 of 2019(7) dt.04-12-2019 2/2 direction has already been issued, no other and further orders are required to be passed with regard thereto. The order dated 15.12.2018 passed by the learned Additional Sessions Judge-II, Danapur indicates that the trial is in progress and there is no inordinate delay. As such having given thoughtful consideration, the bail application stands dismissed.
