Since the petitioner had identical marks vis-à-vis other selected candidates, and the petitioner is younger in age than one who has been selected, the reason for non-selection is obvious pending availability of the post so advertised.

So far as the pendency of vacancies is concerned, that is not a matter to be decided by appointment of more people against those vacancies. That is a matter for the State to decide as a matter of policy. There is no infirmity for the non-appointment of the petitioner.

The writ petition is dismissed.
