JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 379/511/401 of the Indian Penal Code, Sections 15(2)/15(4) of the Petroleum & Mineral Pipeline Act 1962 (Amended Act, 2011), Sections 3⁄4 of the Explosive Substance Act and Section 3/4 of the Prevention of Damage to Public Property Act, 1984.
Allegation against the petitioner and others is of commission of attempt to commit theft of raw petrol. Submission of the petitioner is that after the present case the petitioner was remanded in several cases. In para3 of the bail petition though the petitioner is not F.I.R. named
Patna High Court Cr.Misc. No.8654 of 2017 (4) dt.10-04-2017 2/2 accused in any of the cases save and except a few case which relates to family dispute in the village. Petitioner is in custody since 19.09.2016.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Jamui/Successor Court, in connection with Sessions Trial No.250 of 2016, arising out of Simultalla P.S. Case No.54 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
